These Terms of Service (“Terms”) apply when you access or use the Website, create an account, place an order, or otherwise use any service made available through the Website (collectively, the “Services”).
By using the Website or placing an order, you agree to these Terms, together with our Privacy Policy, Shipping Policy and Return & Refund Policy. If there is any conflict between these Terms and a right or remedy that cannot legally be excluded, the non-excludable right or remedy will prevail.
2. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy available to you under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law (“ACL”), or any other applicable law that cannot lawfully be excluded, restricted or modified.
Our goods come with guarantees that cannot be excluded under the ACL. If a product has a major failure, you may be entitled to reject the product and choose a refund or replacement. If a failure is not major, we may be entitled to provide a repair or replacement within a reasonable time. Other remedies may also be available under applicable law.
Any voluntary change-of-mind return period offered in our Return & Refund Policy is additional to, and does not replace or limit, your rights under the ACL.
3. Eligibility and Acceptable Use
You must be at least 18 years old, or have the consent and supervision of a parent or legal guardian, to place an order through the Website.
You must not use the Website or Services:

for an unlawful, fraudulent or unauthorised purpose;

to infringe the intellectual property, privacy or other rights of any person;

to upload or transmit viruses, malicious code or other harmful material;

We may suspend or restrict access to the Website where reasonably necessary to protect the Website, our customers, our business or third parties, or to comply with law.
4. Product Information
We take reasonable care to ensure that product descriptions, photographs, measurements, colours, materials and other information are accurate. However, colours and appearance may vary depending on lighting, photography and the settings of your device.
Product measurements are approximate unless stated otherwise. Because garments can vary by style, cut and fabric, you should review the size guide and product-specific information before ordering. References to sizes are intended for the Australian market unless a product page clearly states otherwise.
Product images are illustrative. Accessories or styling items shown in an image are not included unless they are expressly listed in the product description.
Nothing in this section limits your rights if a product is materially different from its description, sample or demonstration model, or otherwise fails to comply with a consumer guarantee.
5. Prices, Currency and Promotions
Unless stated otherwise, prices displayed on the Website are in Australian dollars (AUD). Taxes that we are legally required to collect will be included in the displayed price or clearly shown at checkout, as applicable.
Delivery charges, if any, will be displayed before you complete your purchase.
Promotional prices, discount codes and multi-buy offers are subject to the conditions stated with the promotion, including any start and end dates, eligible products, minimum quantities or exclusions. Unless expressly stated otherwise:

only one promotional code may be used per order;

automatic discounts are applied only when the stated eligibility conditions are met;

discounts cannot be applied retrospectively after an order has been placed; and

a promotion may be withdrawn or corrected where there is a genuine error, technical malfunction, fraud or misuse, subject to applicable law.
Any “was”, “compare-at”, percentage-off or similar price comparison is intended to refer to a genuine prior selling price or other lawful comparison. We will not knowingly use inflated or misleading comparison prices.
6. Orders and Contract Formation
The display of products on the Website is an invitation to place an order and is not, by itself, acceptance of an order.
When you submit an order, you offer to purchase the selected products at the price and on the terms shown at checkout. We will send an order acknowledgement to the email address you provide. An automated acknowledgement confirms that we received your order; it does not necessarily mean that the order has been accepted.
A sales contract is formed when we expressly confirm acceptance or dispatch the order, whichever occurs first. We may decline or cancel an order before acceptance where reasonably necessary, including because:

the payment was not authorised;

there is an obvious pricing or product-information error;

we reasonably suspect fraud, misuse or an unauthorised transaction;

an order exceeds a stated quantity limit; or

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order to the original payment method within a reasonable time. This does not limit any additional rights you may have under applicable law.
7. Payment and Account Information
You agree to provide current, complete and accurate order, billing, delivery and contact information. You authorise us and our payment providers to process the payment method selected at checkout for the total amount shown.
Payments are processed by third-party payment providers. We do not directly store complete payment-card details. Your use of a third-party payment service may also be governed by that provider’s terms and privacy practices.
If you create a customer account, you are responsible for maintaining the confidentiality of your login credentials and for notifying us promptly of any suspected unauthorised use.
8. Order Changes and Cancellations
We begin processing orders promptly. If you need to change or cancel an order, contact info@bellemontsisters.com as soon as possible with your order number.
We will try to accommodate the request, but we cannot guarantee a change or cancellation after an order has entered fulfilment or been dispatched. If an order cannot be cancelled, you may request a return after delivery in accordance with our Return & Refund Policy and your rights under the ACL.
Nothing in this section limits your rights where goods are faulty, unsafe, incorrectly described or otherwise fail to meet a consumer guarantee.
9. Delivery and Fulfilment
Orders may be fulfilled and dispatched by us or by fulfilment partners located outside Australia, including in Asia. The dispatch location does not change the identity of the seller or reduce your rights against us under applicable consumer law.
Delivery estimates are estimates only and are not guaranteed delivery dates unless we expressly agree otherwise. Delays may occur because of carrier operations, customs processing, severe weather, public holidays, incorrect address details or circumstances outside our reasonable control.
We will take reasonable steps to deliver within the timeframe communicated to you. If delivery is materially delayed or an order does not arrive, contact us so that we can investigate and provide any remedy required by law.
You are responsible for providing a complete and accurate delivery address. If a parcel is returned because the address supplied was incorrect or incomplete, we may charge the reasonable cost of redelivery where permitted by law and disclosed to you before redelivery.
Where import duties, customs charges or similar government charges lawfully apply, responsibility for those charges will be stated at checkout or in our Shipping Policy where reasonably practicable. We will not impose undisclosed mandatory charges after purchase.
Risk in a product passes to you when the product is delivered to you or to a person authorised by you to receive it. This does not affect your rights for loss or damage occurring before delivery.
10. Returns, Refunds and Consumer Guarantees
Our Return & Refund Policy explains our change-of-mind process and how to request a return. It forms part of these Terms.
For a change-of-mind return, you may be required to return the item unused, unworn, unwashed and with its original tags and packaging, subject to the conditions and timeframe stated in our Return & Refund Policy. Reasonable change-of-mind return postage may be your responsibility if this is clearly disclosed in that policy.
Change-of-mind restrictions for hygiene-sensitive items do not apply where an item is faulty or where you are otherwise entitled to a remedy under the ACL.
If a product is faulty, unsafe, materially different from its description or otherwise fails to meet a consumer guarantee, contact us at info@bellemontsisters.com. We may request reasonable evidence, such as photographs and the order number, to assess the issue. We will not require you to return a product at your expense where the law requires us to bear reasonable return costs.
Refunds approved by us will be returned to the original payment method unless otherwise agreed or required by law. Financial institutions may take additional time to display a completed refund.
11. Availability and Changes to Products or Services
Products may be available in limited quantities. We may change, suspend or discontinue products, features or Services at any time. These changes will not affect an order that we have already accepted unless we contact you and provide an appropriate option or remedy.
We may update prices before an order is placed. A price change will not apply retrospectively to an accepted order, except where you agree to the change or where correction is permitted by law following an obvious error.
12. Errors and Corrections
The Website may occasionally contain typographical errors, inaccurate availability information or other mistakes. We may correct an error and update the Website at any time.
If an error affects an order you have submitted, we will contact you as soon as reasonably practicable. Depending on the circumstances and applicable law, we may offer to proceed on the corrected terms, provide an alternative, or cancel and refund the affected item. Nothing in this section permits us to mislead consumers or avoid an obligation imposed by law.

The Website may contain links to, or integrations with, third-party websites, applications, payment services, social platforms or other tools. Third parties operate their own services and are responsible for their own content, security, availability and privacy practices.
We are not responsible for a third-party service merely because we provide a link to it. However, this section does not exclude responsibility that cannot lawfully be excluded, including responsibility we may have for representations we make about a third-party product or service.
14. Reviews, Comments and User Content
If you submit a product review, photograph, comment, suggestion or other content (“User Content”), you confirm that:

it is accurate and is not misleading;

it does not infringe another person’s rights; and

it is not unlawful, defamatory, abusive, obscene or malicious.
You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit and display that User Content for operating and promoting our business, subject to applicable privacy and consumer laws. You retain ownership of your User Content.
We may moderate or remove User Content where we reasonably believe it breaches these Terms or applicable law. We will not edit reviews in a way that creates a misleading impression of customer feedback.
15. Intellectual Property
Unless otherwise stated, the Website and its content—including text, graphics, branding, logos, photographs, videos, layout and software—are owned by or licensed to us and are protected by intellectual property laws.
We grant you a limited, revocable, non-transferable licence to access and use the Website for personal, non-commercial shopping purposes. You must not reproduce, distribute, modify, sell, exploit or create derivative works from Website content without our prior written permission, except as allowed by law.
16. Privacy
Our collection, use, storage and disclosure of personal information are described in our Privacy Policy. By using the Services, you acknowledge that your information may be processed by service providers located in Australia and overseas, including providers involved in website hosting, payment processing, customer communications, analytics, fulfilment and delivery.

17. Disclaimer and Limitation of Liability
To the maximum extent permitted by law, we do not guarantee that the Website will always be uninterrupted, secure or error-free. We may temporarily suspend access for maintenance, security or operational reasons.
Nothing in these Terms excludes, restricts or modifies:

the consumer guarantees or any other right or remedy under the ACL;

liability for fraud, fraudulent misrepresentation, wilful misconduct or any other liability that cannot lawfully be excluded; or

any statutory right you may have against us.
Subject to the paragraph above, and to the maximum extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable when the relevant contract was formed. This limitation does not apply where such loss results from our breach of a non-excludable consumer guarantee or where the law otherwise prohibits the limitation.
18. Indemnity
To the extent permitted by law, you are responsible for loss reasonably suffered by us as a direct result of your unlawful use of the Website, your material breach of these Terms, or your infringement of another person’s rights.
This section does not require you to indemnify us for loss caused by our own negligence, breach of contract, breach of law or wrongful act, and it does not limit any rights available to you under the ACL.
19. Suspension and Termination
You may stop using the Website at any time.
We may suspend or terminate your access where we reasonably believe you have materially breached these Terms, engaged in fraud or unlawful activity, or created a security risk. Where reasonably practicable, we will provide notice and an opportunity to address the issue.
Termination does not affect rights and obligations that arose before termination, including payment obligations, accepted orders, intellectual property rights and provisions that are intended to survive termination.
20. Severability and Waiver
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be read down to the minimum extent necessary or severed. The remaining provisions will continue in effect.
A delay or failure by either party to enforce a right does not waive that right.
21. Entire Agreement
These Terms and the policies expressly incorporated into them constitute the agreement between you and us concerning your use of the Website and purchase of products. They do not exclude any representation, guarantee, right or remedy that cannot lawfully be excluded.
22. Changes to These Terms
We may update these Terms from time to time, including to reflect changes to our Services, business practices or legal obligations. The updated Terms will be posted on this page with a revised “Last updated” date.
Changes will apply prospectively from the date they are published and will not retrospectively alter an order already accepted unless required by law or agreed with you.
23. Governing Law and Disputes
These Terms are governed by the laws of Australia and, where applicable, the laws of the Australian state or territory in which the customer ordinarily resides.
Before commencing formal proceedings, we encourage you to contact us at info@bellemontsisters.com so that we can try to resolve the matter promptly. Nothing in this section restricts your right to contact the Australian Competition and Consumer Commission, your state or territory consumer protection agency, a court or tribunal, or any other regulator or dispute-resolution body available to you.
The parties submit to the non-exclusive jurisdiction of the courts and tribunals that have jurisdiction under applicable Australian law.
